General

The rental of a WENCKSTERN© Hot Rod vehicle — hereinafter referred to as the "vehicle" — is carried out exclusively on the basis of a written rental agreement and these rental conditions. Any additional agreement must be included in the rental agreement in writing in order to be effective. The subject of the rental agreement is the rental of a vehicle for the period specified in the rental agreement. The rental price results from the Operator's current price list at the time of booking. The Operator is free to refuse the rental without giving reasons.

1. Operator

These Terms & Conditions ("Terms") govern the use of services provided by The Fun Enterprise S.r.l. (CUI: RO 39932905), headquartered at Calea Floreasca 246B, Bucharest, Romania, operating under the brand name "HotRodFun Bucharest" ("we", "us", "the Operator", "the Lessor").

2. Booking, Payment & Cancellation

Bookings can be made online at hotrodfunbucharest.com or through authorised third-party platforms. The renter/driver is obliged to pay the rental price shown in the booking to the Operator. The booking becomes binding after confirmation by the Operator in text form and one or more vehicles are reserved for the renter/driver on the agreed date. Full payment is required at the time of booking unless otherwise agreed. We accept credit/debit cards, bank transfers, Apple Pay, Google Pay, and cash (on-site only).

Prices are listed in EUR. Payment in RON is accepted at the exchange rate of the day. All prices include VAT where applicable.

Cancellation by the renter/driver:

  • 14 days or more before the tour: 100% refund. Alternatively, you may coordinate a new date or receive vouchers for the total booking value, usable within 3 years.
  • 3–14 days before the tour: 50% refund. Alternatively, you may coordinate a new date or receive vouchers for the total booking value, usable within 3 years.
  • Less than 3 days before the tour: No refund. In individual cases, an alternative date may be coordinated or vouchers issued at the Operator's discretion.
  • No-show: If the renter/driver does not appear at the agreed time or the rental agreement is not concluded for reasons attributable to the renter/driver, the renter/driver must pay at least 50% of the communicated rental price as flat-rate compensation for lost rental income. The renter/driver reserves the right to prove that the Operator suffered no or lesser damage.

Cancellation by the Operator:

If the Operator cancels the tour (e.g. due to unsafe weather conditions or force majeure), the Operator will offer an alternative date or issue vouchers for the total booking value, usable within 3 years. If the renter/driver is unable to accept an alternative date or voucher, a 100% refund will be issued.

In the case of cash vouchers, the full voucher value can be applied. In the case of product-related vouchers, these are not affected by any price adjustments and entitle the renter to participate in the event without additional payment, even if the price has changed.

3. Participation Conditions

  • Participants must be at least 18 years old.
  • A valid Category B driving licence is required (international driving permits accepted). A photo or copy is not sufficient — the original document must be presented.
  • A valid ID card or passport must be presented.
  • Height requirements: minimum 1.60 m, maximum 1.95 m. Maximum weight: 125 kg.
  • Participants must have zero blood alcohol content (0.0‰) and must not be under the influence of drugs, medication, or any other substance that impairs driving ability.
  • Pregnant persons are not permitted to participate.
  • The renter/driver must be physically and mentally able to drive the vehicle safely. The Operator or its employees may prohibit the trip or its continuation if they have reasonable doubts about the renter/driver's fitness to drive.
  • All participants must attend the mandatory safety briefing and test sitting before the tour.
  • Helmets approved in accordance with applicable regulations are mandatory and are provided by the Operator.

4. Special Information — Use at Your Own Risk

The renter/driver is advised that the rented vehicles are special vehicles. The vehicles are not comparable to normal passenger cars in terms of operation and driving behaviour, so even experienced drivers must familiarise themselves with the operation and driving characteristics. The renter/driver expressly accepts the associated higher risks compared to ordinary road vehicles. Use is at the renter's/driver's own risk. The Operator is not liable for damage resulting from risks associated with the special design of the vehicles.

The renter/driver is particularly advised of the following design features and risks:

  • The vehicle is smaller in size and may be less visible to other road users.
  • The vehicle does not have the usual safety features such as ABS, seat belts, or airbags.
  • The vehicle has direct steering — small steering wheel movements result in large changes in direction.
  • The brakes must be operated with the left foot and do not have a brake booster.
  • The vehicles do not offer weather protection. The Operator is not liable for weather-related discomfort, damage, or dirt.

The renter/driver and any co-drivers are obliged to familiarise themselves with the operation of the vehicle and its special features before starting the journey, particularly steering and braking behaviour. If anything is unclear, the renter/driver must consult the Operator or its employees during the handover and instruction. The renter/driver may only start the journey once they are able to safely control the vehicle.

5. Taking Over the Vehicle

The vehicle will be handed over to the renter/driver in a roadworthy, undamaged, and technically and visually satisfactory condition, with fuel and all accessories. Any pre-existing damage is documented in the damage card, which the renter/driver may inspect before the tour starts. The renter/driver is obliged to inform the Operator of any complaints when the vehicle is picked up and must ensure these are documented in writing in the damage card. The renter/driver will be instructed in the special features of operating the vehicle upon handover.

6. Use of the Vehicle & Exclusion from Participation

The vehicle may only be used as part of a guided tour on a specified route. All instructions from the guide/Operator must be followed at all times.

If the renter/driver fails to follow instructions (including but not limited to aggressive driving, overtaking, racing, or failure to follow traffic laws), the Operator reserves the right to exclude the renter/driver from the tour, including during the event. In such cases:

  • The cost of returning the vehicle to the departure point (€250 / 1,250 RON) must be borne by the renter/driver.
  • The renter/driver bears the full cost of any lost rental income due to the vehicle not being available for the next rental.
  • No refund will be issued.

If the renter/driver loses contact with the group or guide, they must immediately stop at a safe location and contact the guide. The trip may only be continued with the guide's consent.

The renter/driver is prohibited from:

  • Making phone calls or taking photographs/videos while driving.
  • Subletting or giving the vehicle to third parties.
  • Using the vehicle outside the designated tour route without Operator consent.
  • Transporting hazardous substances or towing other vehicles.
  • Transporting items other than personal belongings (clothing, handbag).

7. Return of the Vehicle

The renter/driver will return the vehicle with all accessories properly, at the agreed time and location. If there is a breach of duty by the renter/driver, the Operator is entitled to demand early return or to terminate the rental agreement without notice. The renter/driver must bear any further damage resulting from late return.

8. Obligations in the Event of Damage or Breakdown

In the event of damage or breakdown, the renter/driver is obliged to take all measures necessary to minimise damage and preserve evidence, including:

  • Calling the police immediately, even in accidents without third-party involvement or self-inflicted accidents.
  • Recording the place and date of the accident, names, addresses, and registration numbers of all parties involved and witnesses, and preparing a sketch.
  • Not making any statements regarding fault — in particular, no admission of guilt.
  • Taking appropriate safety precautions for the vehicle. The renter/driver may not leave the scene until obligations have been fulfilled.
  • Reporting any theft immediately to the police and the Operator.

The renter/driver must report any damage to the Operator immediately, personally, completely, and truthfully. The renter/driver is obliged to support the Operator and its insurer, provide all necessary information, and submit a truthful written description of the incident.

Any work on the rental vehicle (e.g. repairing damage) is only permitted with the Operator's express prior consent. Expenses incurred without consent will not be reimbursed.

9. Liability & Security Deposit

In the event of damage caused by the renter/driver, photo documentation will be taken and a damage report will be prepared and signed by both parties.

The renter/driver will provide a security deposit of €2,000 (or RON equivalent), unless reduced to €250 by purchasing the optional Damage Waiver (see Section 10). The deposit reduction does not apply in cases of intent or gross negligence.

The Operator will provide the renter with complete damage documentation electronically within 5 working days, including a cost estimate for vehicle repair and any downtime / lost rental income.

If the cost estimate is less than the security deposit, the Operator will refund the difference to the renter/driver.

10. Damage Waiver (Reduction of Liability)

The vehicle is not fully insured. The renter/driver may reduce their liability for damage caused by simple negligence or for loss of the vehicle by paying an additional fee. This reduces the maximum deductible from €2,000 to €250 per damage event.

The Damage Waiver does not apply to:

  • Damage caused by gross negligence — the renter is liable in proportion to the severity of fault.
  • Damage caused intentionally.
  • Intentional violation of contractual obligations under the rental agreement.
  • Driving under the influence of alcohol, drugs, or impairing substances.
  • Damage caused by deviating from the designated tour route without Operator consent.
  • Damage to third-party property or persons.

Participants who do not purchase the Damage Waiver are fully liable for any damage caused to the vehicle during the tour, up to the full replacement value.

11. Insurance

The rental price includes motor vehicle liability insurance to at least the minimum extent required by Romanian law. This does not cover damage to items in or on the vehicle.

12. Defects in the Vehicle

The Operator must ensure that the vehicle is in proper condition and make it available on time. If defects impair contractual use or the vehicle breaks down for reasons not attributable to the renter/driver and the Operator does not remedy the defect or provide a replacement vehicle within 80 minutes of becoming aware, the renter/driver may withdraw from the contract. In this case, the renter/driver is entitled to a refund of payments already made. Any further damages (travel costs, other rental costs) will not be reimbursed unless the Operator caused the non-fulfilment intentionally or through gross negligence.

13. Liability of the Operator

Participation in HotRodFun tours is at the participant's own risk. The above liability limitations do not apply to:

  • Damages resulting from injury to life, body, or health due to a negligent or intentional breach of duty by the Operator.
  • Damages covered by liability under applicable product liability law.
  • Damages based on intent, gross negligence, or fraud on the part of the Operator.

The Operator is liable for damage caused by slight negligence only insofar as it relates to the violation of contractual obligations essential to achieving the purpose of the contract (cardinal obligations), and only for damage typically associated with the contract and foreseeable. The Operator is not liable for slightly negligent breaches of non-essential secondary obligations. The liability limitations do not affect statutory consumer rights.

14. Photo & Film Recordings

The renter/driver agrees that photographs and/or video recordings may be taken during the tour. The Operator holds the usage rights to these materials.

The renter/driver grants the Operator and its marketing partners permission, free of charge, to use such photographs and videos for advertising and promotional purposes. Contact details (email, phone number) collected at the time of booking may be used to share tour photos/videos with participants and to inform them of further offers via newsletter. The renter/driver may withdraw this consent at any time by contacting the Operator.

15. Gift Cards & Vouchers

Gift cards are valid for 12 months from the date of purchase. They are non-refundable and non-transferable for cash. Gift cards can be redeemed for any available tour, subject to availability.

In the case of cash vouchers, the full voucher value can be applied. In the case of product-related vouchers, these are not affected by any price adjustments and entitle the holder to participate in the event without additional payment, even if the price has changed since purchase.

16. Data Protection

We process personal data in accordance with our Privacy Policy and applicable data protection regulations, including the EU General Data Protection Regulation (GDPR). The renter/driver agrees that personal data necessary for the transaction will be stored and processed by the Operator in accordance with applicable law.

17. Governing Law

These Terms are governed by and construed in accordance with the laws of Romania. Any disputes shall be resolved by the competent courts in Bucharest, Romania. EU consumer dispute resolution: the European Commission provides a platform for online dispute resolution (ODR) at ec.europa.eu/consumers/odr.
